Panama Real Estate Purchaser Legal Representation

If you are seeking to purchase a piece of real estate in Panama and wish to have independent legal representation this is what is involved.

  1. We represent and work for you, not any real estate brokers or sellers. We care only about you. There is no conflict of interest. Lawyers referred by the seller, broker or developer may have a conflict of interest in that they want more referrals. If we think you are in a bad deal we will tell you so and specifically why we think this.
  2. We will negotiate any deposit agreements and make sure you get a detailed receipt for any deposits made on any real estate.
  3. We will negotiate and/or create the real estate purchase agreements. We will make a point of protecting your interests and pay special attention to repairs, renovations and other modifications making sure they are included in the agreement.
  4. We will manage the escrow for you and make sure you do in fact get clear title at the time of escrow close.
  5. We can advise you on titling the real estate to a corporation, foundation or putting it in a personal name. Discussions regarding Panama taxes are always welcome.
  6. If the project is not yet completed we can make inquiries in the real estate community as to the reputation of the developer. We can drive by the site and advise you as to what it likes like if it is in Panama City.

For all of the above we charge $1500, which is paid at the start of the work.

Due Diligence for Real Estate Projects Not Yet Completed - For extra cost we can research the developer in the courts to see if he is involved in active lawsuits related to that project or other projects he has or had in the recent past. This may be informative to you while making the buying decision. We can also inspect his other properties and projects to see what state of development they are in. We can see if the project has active building permits etc. Pictures of the site will be taken for you. Sometimes the extra expense of this due diligence can prove to be well worth the expense even if it just provides peace of mind to you. Normally this work runs $600 to $1000.

Buyer Remorse Refunds – Lets say you have placed a deposit on a piece of property and want to back out. We can review all the documents and let you know where you stand legally. Next we can contact the developer and request the funds be returned and possibly enter into negotiations based on the merits of the case. Each case can be different.

Developer Breech of Contract – Perhaps the developer is not performing according to the written agreement and this has caused you to get cold feet and you want out. Again each case needs to be looked at individually but we can help negotiate with the developer/seller on your behalf and if warranted litigate a claim against them in court.

Filing Developer Complaints – There are less severe measure short of litigation that can be taken against a developer such as filing a lawful complaint against the developer with the government in Panama. While this does not guarantee financial relief developers are let us say not fond of such a complaint that is lawfully and correctly filed.
