Introduction – Many clients ask us if the favorable asset protection laws in Panama are going to change. We say no. In fact the wind is blowing the other way and they have tightened up the laws affecting personal privacy. We are referencing Article 188-A on this page.
Public Domain Documents - Now it is unlawful to bring into the public domain any document that was not intended to be entered into the public domain. This is moving things in Panama for the better.
Private Investigations Prohibited – Recent changes in the law have made it illegal to go around conducting private investigations. Of course the Panama government can still conduct investigations but private people including private investigators may not conduct investigations. People who are employed by the government of a country other than Panama are considered private people since they have no official status in Panama and are thus prohibited from conducting any private investigations. They could not go around to people or businesses in Panama attempting to gather information and have questions answered. It would be illegal for them to do such things in Panama even though they had status as government officials in their home country. There is no prohibition on accessing documents in any public registry. Of course Panama Bearer Share Corporations and Panama Private Interest Foundations have no ownership information in any public registry or database.
Paparazzi Activities Illegal – The recent changes in Panama Law make what is considered normal Paparazzi activities in other countries to be illegal here. One cannot go around filming or photographing people as they move about in public places, or as they enter or exit restaurants, homes or places of business. If your intent is to photograph a beach and people walk through your movie or photo that is not what we are talking about. In this scenario you intent was to photograph or film the Panama beach, not the person. Activities where the intent is to film or photograph a person are prohibited. This of course criminalizes being a Paparazzi and should cause an influx of celebrities in Panama since Panama may be the only jurisdiction to prohibit such activities. This of course would make it illegal for anyone to go a round filming and or photographing specific people including employees of other governments. Employees of governments other than the government of Panama have no status in Panama as other than regular tourists or people here on a work visa.
Conclusion – It is easy to see from these very recent changes in the laws of Panama that the legal climate is one of increasing personal privacy and security, not diminishing it. Panama is the best offshore tax haven jurisdiction in the world.
