Executive Summary – Mexico has passed a law eliminating criminal penalties for possessing small amount of Marijuana (5 grams is maximum allowed), Cocaine (half of a gram), Heroin (50 milligrams), LSD (o15 milligrams), Methamphetamine (40 milligrams). People apprehended a third time under the new law would be forced to enter into a treatment program.
Discussion – This new law will encourage drug abuse tourism. Before the new law tourists caught with small quantities of the drugs could be extorted by police using the threat of criminal charges being filed against them. They would be taken in, held, and eventually they are going to the atm machine or having funds sent by western union to bribe their way out of what the tourist thinks is going to be a long jail sentence. Now the police have nothing to scare them with as long as the quantities are small. Bear in mind a group of two couples could have with them a combined 2 grams of cocaine, which is a fairly sufficient amount to party with the whole evening, plus marijuana and other drugs. This is not going to hurt the drug trade and in fact may bolster in Mexico sales of personal use quantities of drugs to tourists. The dealers are still vulnerable to criminal prosecution but there is sufficient corruption they have to hide behind. A complete legalization of the drugs in any quantity is what is needed. This is a small step in the right direction. Perhaps this is to test the water and then the law will be expanded to eliminate quantities for cultivation and sales. Other Central and South American States are moving in this direction rapidly. Cocaine leaf is freely available for sale in any quantity in Peru, Venezuela and Bolivia.
