Executive Summary – Lichtenstein made a deal with the USA to drop bank secrecy in any case where the USA “suspects” bank secrecy. The USA would be entitled to bank information when they are investigating a suspect in a tax avoidance case. Of course every USA citizen and Green Card holder is going to be a suspect. Previous to this agreement the USA had to prove tax fraud before getting into the records. Normally they go on a fishing expedition to get the records lacking any evidence or proof at all and then after getting the records they are sometimes able to make a case for tax fraud. Now all they USA has to do is be suspicious. This would close the door for all Americans.
European Union – It is expected that Lichtenstein will also make a similar deal with the EU countries but they are asking for double taxation treaties in return. We will wait and see how it turns out.
About Lichtenstein – This is a small European country not in the EU. The population is about 35,000. The size of the country is slightly smaller than Washington, D.C. It is run by a monarchy but also has a legislature. This is a landlocked country with no military or ability to defend itself that is operating as a tax and banking haven.
Last year the German Intelligence service orchestrated what appears to be illegal download of the clients of a Lichtenstein bank owned by the royal family. The list was turned over to many countries to pursue these individuals. One could assume the data the Germans obtained was an embarrassment to Lichtenstein and they needed to take some corrective action. What the threatened consequences were going to be we do not know – could have been a blacklisting of their banks, a trade boycott, actual arresting of the royal family who owned the banks, confiscation of assets, or whatever?
Implications - If Germany was involved in an illegal act to obtain secret bank records in Panama it would be interesting to see how they would ship Mercedes, VW, and BMW cars around the world without using the Panama Canal and of course not using the worlds second largest duty free zone in Colon, Panama.
