Executive Summary – The country of Lichtenstein agreed to exchange information with the USA for tax purposes. There are some simple qualifying terms that must be met before the information gets released to the USA. It appears that the USA citizen must have undeclared assets in Lichtenstein and be under investigation by the USA authorities.
It is not an automatic exchange of information. Previously the USA had to prove tax fraud, which is near impossible without the bank records in Lichtenstein. The new agreement goes into effect on Jan 1, 2010 and has a look back period covering the 2009 tax year. Anything before this period is not covered by the agreement. So the USA Lichtenstein account holders will hit the road and relocate to other jurisdictions is all.
Discussion – Lichtenstein a country of 35,000, got pressured into agreeing to a tax treaty with the USA a super power. They are a defenseless country. The fact that Germany illegally obtained account information regarding Lichtenstein account holders is something of course not being discussed. This information was turned over to the USA authorities, which it appears led the way for the charge on Lichtenstein. The fact that this information is the fruit of a crime is also not being discussed. Double standards.
Lichtenstein did manage to save the USA account holders by not starting the treaty for some time and preventing it from being retroactive. All that has to happen for a USA citizen is they move their money away from Lichtenstein before 2009 and they are unaffected by the new agreement. It seems like the USA is trying to get the tax havens to avoid taking on USA citizens. This brings to mind the Cuban cigars. You can buy one anywhere in the world except the USA.
USA citizens should go out and get second citizenships before it becomes prohibited to do so and then they could bank anywhere freely. Now there is not even any requirement to disclose the second citizenship. Name changes are also possible without disclosing the name change to anyone.
