Executive Summary – The French authorities got some stolen bank data on 10 or less people banking in Switzerland who were French citizens. France admits this and also admits grouping this data in with other data obtained through more lawful channels. The estimate as to the amount of people the French got data on generally varies from 3-7 and is agreed on by all to be 10 or less. So it is not such a big event unless you are one of those people.
Nullification Of Swiss French Tax Treaty – France and Switzerland agreed to sign a Tax Information Sharing Agreement in August 2009. This would help France go after their people banking in Switzerland. The Swiss Finance Minister asked their Parliament to not ratify the treaty with France, which was pending awaiting signatures as a punishment for what the French did. We await the outcome of this.
Implications – Stolen data is forbidden fruit of a crime. Think “Possession of Stolen Goods” and “Theft” as the crime. So the crime the French are guilty of is this plus conspiracy, fraud and a number of other charges. Get this if they used the stolen data to get tax money then the money perfectly meets the test of money laundering. The French are trying to justify the crime of stealing by saying the end justifies the means. This is the end of a free society and the emergence of a dictatorship when they start acting like this. No ones life was at stake like in a kidnapping, it was a tax matter. The crime of theft and conspiracy was worse then the tax matter violation. Interesting to see how this ends. The Swiss may hang tough but I doubt it. The Swiss seem determined to sell out the people who trusted them all these years.
