Asset Protection Definition – Asset protection is a term referring to keeping your assets safe from the reach of financial enemies. Often the best way to do this is to remove the assets from the reach of flawed court and legal systems where there is no protection of privacy and where the lawyers are running around out of control. This works when dealing with cash, securities and some other forms of assets but not all assets are portable and must be dealt with differently. Trouble can also come in the form of kidnapping, blackmail, extortion, home invasions, or identity theft. We will explain some ways in which you can reduce your asset profile and to varying degrees drop off the radar screens as a target.

Profile Reduction – This is an approach to asset protection that is best employed before trouble comes knocking on your door. The best way to reduce your profile is to have as many of your assets as possible held by anonymous formations such as Panama Foundations and Panama Bearer Share Corporations. The ownership of these formations is not recorded anywhere so the ownership of these entities is not directly tied to you. No one can look up a Panama Corporation or a Panama Foundation to see who the owners are – the owners are never recorded anywhere. When you do this you no longer appear to be a suitable target for litigation, kidnapping, identity theft, blackmail, extortion etc. Lawyers want to make sure there is a pot of gold at the end of the litigation rainbow before they embark on a costly legal campaign. If they can not find your pot of gold they will be likely to go find a different target to litigate against. Litigators are law firms that make money suing people and if they do not sue people and win against people who have assets they can identify, they do not pay their bills. In some countries they do this on contingency which means they can keep 40% of what they collect for their clients but they generally have to absorb all the costs of the litigation under such arrangements thus it is easy to see why they like to make sure the pot of gold is there before they begin.
So the idea is to remove as many ties between you and your assets so you do not appear to be as wealthy as you are. Flaunting wealth today is a dangerous game best not played.

Real Estate Asset Protection – Real estate is the number one asset that people go after because ownership can be determined easily (well not the way we do it) and the real estate is not portable. The way it is done follows: Real estate is titled in the name of a Panama Foundation or a Panama Bearer Share Corporation. This keeps the real estate out of your name placing it instead in the name of a corporation or foundation that is anonymous in that the ownership of such can not be looked up anywhere. When a lawyer does an asset check they check to see what is registered in your name so this plan would accomplish the goal in that your name would not come up in association with the asset. It would be most difficult to do this if the real estate was not free and clear. Non- conventional financing would be a possibility. Conventional financing requires reportage to credit bureaus which are anything but secure (don’t believe this just check and see how many identity thefts are reported in your country each year). Credit bureaus can leave nasty trails.

Equity Stripping – This is a practice that removes the equity from real estate thus decreasing the property from becoming a target for litigation. This can be done by borrowing against the property removing most of the equity. Usually if a property has 80% of it’s appraised valued tied up in loans the property will be considered to have no available equity which means it is not going to become a target. If a lawyer tries to do a forced sale the property will not sell for enough to pay off the existing debt thus nothing happens except the lawyer loses time and money and collection lawyers know better. Panama Foundations and Panama Corporations can make loans against real estate and record the loans to tie up the equity in the real estate. Not having real estate in your name at all is a far better strategy.

Asset Protection and Credit Reports – Credit reports are far from private. Shop clerks can readily obtain them. They are known to contain erroneous information. The people that pay for these credit reporting agencies use them to harass those they wish to harass with negative entries. They are generally a pain for any consumer. The reporting business has way too much power over the consumer. Why not just drop out of the whole credit reporting system. You will remove any risk of identity theft and be free of these people bothering you anymore. It is easier than you think.

Eliminating the Credit Bureaus from your Life – Get a Panama Foundation and/or Panama Corporation. Use them to open two or three bank accounts in Panama covered by Panama Bank Secrecy. With each bank account get a secured Visa and maybe an ATM card. Close all your credit card accounts in your residence country with all of its privacy invasive practices. Close your in country bank accounts or else keep one for convenience and use it as a decoy to make snoopy people think you are poorer than you are. Use your Panama Visa cards which of course do not report to credit bureaus. These cards work in ATM machines so take cash out in modest amounts to feed into your local bank account thus avoiding any money trails as best as possible. Cash deposits have no trails. Banks in many countries are far from private and any decent private detective can get your bank account history easily. These measures removes from the credit bureaus any ability to determine what you buy, how much you make, how much you spend, what you make payments on, current residence, phone, etc. Do consider paying off any cars, boats, motorcycles and then titling them in the name of the Panama Anonymous Bearer Share Corporation or Panama Foundation. Why not even register your boat in Panama to the anonymous corporation or foundation. This will cause these assets to be hard to find and attack. Arrange for all your public records like drivers license, auto and boat papers, to go to a POB box service. Try to get phones, cable TV, etc in the name of your Corporation or Foundation insisting on this and be willing to pay cash deposit. They may want to see your id for this. It would be nice to have a Panama Passport and driver’s license for this wouldn’t it. Watch magazine subscriptions in that these names and addresses wind up in lots of locator databases. Get subscriptions in another name using the PO Box or abbreviate the name using a first letter for the first name. Keep as much as you can out of your name. Watch for things like utilities, garbage collection, cell phones, cable, internet etc. All of these things can be privacy violating. When it comes to things tied to a residence address use the corporation or foundation or you and your address can wind up in a database that is made public or close to public. People need to find you to sue you or do harm to you. Hire a private detective to help you do this. They will tell you how to not be found. Hire two of them to make sure. After you have made your life private in an unprivate country have the private detective check to see if he can find you. If so make the corrections. It takes time but you can drop out of the consumer databases and then be free of all the telemarketers, identity theft, lawyers and other general harassments. You would then be enjoying life as people did 40 or 50 years ago, imagine that.

Asset protection and Private Detectives - Private detectives can be sneaky. They call phone companies making believe they are repairmen working on the lines and get information that way. If they have your address but want an unlisted phone number at that address they make believe they are working on the lines and ask the office for line numbers for some made up reason. If they are bold they dress up as phone repair people and open the phone box near your house to get the phone number out of the box where it is written on the phone lines. They call banks and get bank account information impersonating you. They use all the personal information they can get on you from the public databases and private databases they subscribe to. Identity theft people seem to use these same databases often hiring private detectives on the internet to run reports on the identity theft victims. Private detectives like to get phone records to see who someone is calling as in cheating spouse. They like to get bank records for lots of reasons, same for credit card records. They can con an ISP into giving them your password and reading your email, switch to hushmail.com. I do need to point out that if you removed yourself from the radar screen as described above the private detective would not be able to invade your privacy except get into your local bank where all the deposits are made with cash taken out of the ATM machine. No checks are written from this bank account either. Payments are made with money orders from post office, checks from the Panama bank, wire transfers and payments by credit card from Panama bank. Private detective games do not work on Panama banks where bank secrecy violations could lead to a prison sentence.

Ultimate Asset protection - The ultimate method is to get up and take yourself and your assets to a privacy oriented jurisdiction like Panama. Not all of you can do this. The next best thing is to take as many of your assets to the other jurisdiction like Panama leaving precious little behind.
