More trouble for and with UBS the Swiss Bank. The mistake UBS made was operating in the USA with sales offices and sending bankers to the USA to see clients. This gave the USA clear jurisdiction over them. So the USA got UBS to agree to $780 million dollars in fines to avoid criminal charges being filed against them. The Swiss Bank also agreed to turn over the names of about 250 -300 Americans who banked with them. If the bank modifies its practices according to the wishes of the USA, helps prosecute others and makes the payments, then in 18 months the USA will drop the charges against the bank. The USA of course is letting them buy themselves off of charges because they have the ability to pay a large fine.
The IRS had requested the names of some 17,000 to 20,000 American account holders under a John Doe subpoena granted by a USA judge who feels he has authority and jurisdiction over this matter. This is not being complied with at this time but the USA may continue to press forward for these names as well. Remember the Swiss blinked first showing weakness. Other countries will probably try their hand at trying to do the same thing to the Swiss Banks in the future. Since the USA is still regarded as a super-power these other countries may not be so successful.
The Switzerland President Merz said that despite the settlement that UBS made with the USA, the Swiss Bank Secrecy Laws would remain intact. Yeah right and I have a bridge that connects New York to London for sale.
