Executive Summary – The states involved are: Alabama, Colorado, Idaho, Michigan, Nebraska, Pennsylvania, South Carolina, South Dakota, Texas, Utah, Florida, Virginia, and Washington State. The basis of the lawsuits is that the fed does not have the power to force people to buy something in that non-action is not interstate commerce which the fed can regulate.
The talking heads are saying things like “Federal Power trumps state power”. This is a false statement. The powers not specifically delegated to the fed are reserved for the states. No power to compel purchases was ever granted to the fed. The attorney generals know this. They also know how to trample the constitution themselves. Ask them why they arrest people for gun laws in violation of the second amendment? Ask them why they engage in secret tribunals called Grand Juries? Ask them why people now have to ask the judge for a free lawyer if they are poor and it may not be granted?
It appears that the states are scared of martial law which will wipe them out as a government so they are opposing Obama on this issue to knock the wind out of his sails. The bill will also throw their states in debt and force them to get more help from the fed and this help will have conditions associated with it that makes them uncomfortable. This is also providing them with a platform to run for governor of their respective states on a states rights platform. I seriously doubt the fed will ever acknowledge states rights in practice. Secession is where the states are headed and the sooner the better.
What if the Fed says the bill is legal? - Well then a line has been drawn in the sand. Anyone with 90 minutes training in constitutional law knows the Obama bill is unconstitutional. If the courts are going to side illegally with Congress then just chuck the whole lot of them is the next line of reasoning the states should follow. Secession is the next step which does not require the approval of the fed. Secession is an act contained within the state and they would just notify the fed of the action after fact.
Will Obama let them go or be like blood thirsty Lincoln. Please remember Lincoln freed the slaves two years into the civil war after many were already killed so lets not paint him out to be a good guy. The South was being run by aristocrats. Business people with a lot of workers and slaves living a lavious lifestyle in many instances. There were of course not so rich men in their ranks decicated to their cause but the leaders were more like aristocrats with slaves. They were not hard “red necks”, ex military, militia or gun enthusiasts leading the south. The opposition Obama would face is are people educated in how the constitution works. They are motivated. They are located all over the US, not just in one region like the South. They have morals and character. They are also fighting for their land, family and freedom and this is the fighter who is really hard to defeat. Obama has superior weapons but really has no forces that would be relied on to fight for him. Think about it. He is 90% bluff. If the people stand up to him he will go hide in Paraguay with Bush to avoid facing treason charges.
What they worry about is what you do, not what you say. King George (The English one not Bush Sr.) did care what the colonists said. When they took action well that got their attention.
